The present document (Terms and Conditions) lays down the conditions for the sales made between people wishing to make a purchase from the Shoes Made in Italy website https//:www.du00.amsterdam, hereinafter referred to as “the customer”, and Shoes Made in Itali, S.M.I., whose registered office is located at Postjesweg 459, 1062JV Amsterdam registered in the Kvk under number 62206028, a individual company with intra-community VAT number NL788047991B01, hereinafter referred to as “Du00 or S.M.I.”. Shoes Made in Italy is subject to the law in the country of its headquarters, which is Netherlands, and to the European Union’s legislation.
You should understand that by ordering Products on these websites, you agree to be bound by these Terms and Conditions. You should print a copy of these Terms and Conditions for future reference.

The products on the web-site Du00.amsterdam, are divided in categories by material, colors, sole. The click on the selected product will lead to the detailed description of the product.

S.M.I. implement a quality control on each individual product. This procedure allows to decrease the cases of products with manufacturing defects
The prices of products are expressed in € Euros and include all taxes and / or applicable taxes, but excluding participation in any delivery charges (see shipping and delivery).
S.M.I. reserve the right to change prices at any time without notice. The products will be invoiced based on the tariffs set to www.du00.amsterdam for each product, at the time of the order confirmation by the customer.
The products remain the property of S.M.I. until the complete receipt of the invoiced amount. The bill, by the customer, must be paid in its entirety, at one time with the payment systems offered on the Website and the invoice will be sent to the customer electronically to the email entered during the purchase
For the purchase of the Products, the Customer must register by entering their personal details and following the instructions provided by the registrar.

S.M.I. will deliver orders received on the website only in the limit of available stock. S.M.I. reserves the right, even after the order confirmation, to cancel the order if the ordered Products already be fully booked. In this

5.1. PAYMENTS ACCEPTED AND SECURITY

All payment systems are managed by a company specializing Mollie www.mollie.nl as described in payment security. If paying by credit card and prepaid card the customer must provide the required data to be managed directly by the banks issuing credit cards. The information will be encrypted through use of encryption systems that prevent the use by third parties.
Once complete, if the latter is successful, the payment system will send the customer an ‘e-mail confirming the transaction.
For payment by Paypal, the customer must provide the required data which will be handled directly by PayPal without having to re-enter
your credit card or debit card.
5.2. PAYMENT SECURITY
S.M.I. In order to ensure a maximum level of security on all payments of its customers, has chosen to entrust the company specialized Mollie, our partners www.mollie.nl all payment processes.

6.1. DELAYS DELIVERY
The delivery service, is entrusted to PostNL.
S.M.I. with PostNL undertakes to ship their products all over the world (for delivery times and costs we refer to the official document) . As from contractual agreements between S.M.I. and PostNL delivery, in Dutch territory, is expected in 24 / 48H.
If the product is marked on the site as “available”, subsequent amendments will in the most rapid time to delivery with express service (in case of payment by bank transfer the delivery time will be calculated

The system will send an email to the customer returning the trackid for shipment identification. If the package is not intact or damaged, the customer must immediately report the allegations to the carrier; otherwise the products will be deemed duly delivered.
S.M.I. proposes the free shipping and delivery in the Netherlands and Europe with POSTNL but in the future, the customer will choose between Express and Standard delivery.
Du00.amsterdam aims to provide a quick delivery service, but is subject to general country transportation structures.
6.2. DELIVERY PROCES
All parcels are delivered at the address the costumer indicate while ordering. Deliveries are processed preferably in the morning, but can occur between 9am and 6pm (local time).
An email is sent to the costumer containing tracking information and POSTNL scheduled delivery day. This day is not contractual, and may vary depending on unexpected events occurring during the shipping process
conducted by POSTNL.
POSTNL delivery services conduct one delivery attempts. PostNL Parcels drivers are equipped with handled terminals that can used to register Proof of Delivery to the door as well as a digitally recorded signature within the meaning of Article 3:15a of the Dutch Civil Code. This digital signature will replace the handwritten signature on distribution list. S.M.I. and PostNL Parcels agree that they will accept this digital signature, or a copy thereof printed on paper, as proof of delivery.
If the costumer is not there on the first attempt, the delivery man may leave the parcel to a neighbor or receptionist if safe (and unless the costumer expressed in advance to S.M.I. that he refused this option).
If no one is available for receiving the parcel, the delivery man will leave a note proposing to the costumer to take the parcel to the nearest point PostNL.
After the third delivery attempt, the parcel will be sent back to S.M.I. and the costumer will be refunded by deducting the cost of shipping
All articles displayed on the Du00.amsterdam website are subject to the legal guarantee as described in the Dutch Civil Cod..
The costumer is expected to refuse the parcel in case he estimates that it is damaged during delivery, so that the parcel will be sent back to S.M.I..
If the costumer accepts the parcel, he has 2 days to notify to S.M.I. any damages in the goods received, via e-mail, on social, or by sending a paper letter with proof of postage to the following address:

After the 2 days delay, the parcel is considered as accepted and cannot be subject to any demand regarding potential damage.
If the items which have been refused by the costumer are proven to be
effectively damaged or misproduced, all amounts paid by the costumer will be fully refunded.
This refund will be processed within a maximum of 30 days.
Du00.amsterdam cannot be considered as responsible for misuse of the items bought.
When S.M.I. not be responsible for failure or delay in the event that:
1) despite having paid the regular and timely purchase of products to cover the Order received, it was not replenished the terms and conditions agreed with the supplier;
2) is not able to make up for the lack of availability of these products, not subject to circumstances beyond its control
3) has promptly informed the customer of such unavailability Du00.amsterdam products.
4) failure or delay in delivery due to force majeure, such as – but not limited to strikes, the Public Authority measures, rationing or shortage of energy or raw materials, transport difficulties, fire, flood, flooding and damage to non-employee industrial machinery by SMI.
SMI promptly notify the Customer the occurrence and the loss of a force majeure event.
If the cause of greater strength persists for a period longer than 30 (thirty) days, either party may withdraw from the contract.
In the case of termination pursuant to this Section, the customer is not entitled to any compensation or damages of any kind, subject to the right to the refund of the amount already paid as consideration for the Order object product, within 30 days following the Order itself.
5) In the event of a purchase made by a customer, the risk of accidental perishing of the Products shall remain with subsequent amendments until their delivery to the customer or to another entity indicated by the latter, regardless of whether the shipment of the Products is or is not ensured.
In the event of a purchase made by a person other than a consumer, the risk of accidental perishing article passes to the customer upon delivery of the product by subsequent amendments the first carrier.
If the Customer finds defects in new products purchased, in accordance with this document, the Customer may contact, under penalty of forfeiture within 15 days of receipt of the Products, S.M.I., as detailed here and require repair or replacement of the Product.
The choice between repair or replacement will remain in the availability of the Customer, except in cases where the chosen remedy is objectively impossible or excessively expensive compared to the other.
S.M.I. will, as appropriate, to make repairs and replacements required within a reasonable period after receipt of the request of the customer which will be e-mail to the following address firstname.lastname@example.org.
Subsequent amendments invites the Customer to describe in as much detail as possible including through the photos attached so, the nature of the fault or defect identified and possibly to transmit a copy of the Order

Where the repair or replacement requests are impossible or prohibitively expensive, or have not taken place within a reasonable period; or they have caused significant inconvenience to the Customer, the latter may

The Customer can exercise the right of withdrawal, without penalty and without giving any reason. S.M.I. accept return up to 15 days from receipt of the product.
Only items which have not been worn can be returned, with the original labels and in the original box.
The Costumer is asked to try the shoes in such conditions that preserve the integrity of the items (for instance by putting on the shoes on a white piece of paper).
Only one return/exchange can be made per order. All items in an order have to be returned in one parcel, and the Customer can exchange a given item only one time.
If the returned items are damaged or are not the initial bought item, S.M.I. will get in touch with the Costumer in order to solve the problem in a friendly way. S.M.I. reserves the right to transfer the issue to a recovery firm if necessary and to ask for accurate penalties.
The Costumer can ask for a refund or an exchange. Exchanges can be processed for a different size or colour or material; if the client wishes to exchange for another item, he will have to ask for a refund and place a new order.
In case of an exchange, the second delivery fees also are fully supported by S.M.I.
The costs for the return shall be borne by the Customer.
All returns, exchanges and refunds are processed directly on the website Du00.amsterdam.
All refunds are processed within 15 days after the items sent back to S.M.I. are re-entered in stock.
Exchanged items are shipped once the former products are re-entered in stock.
S.M.I. reserves the right to store the data of each order as well as the contact details of the Customer for the sole purpose of using them for the correct execution of the Order (including the provision by the trading partners involved in the payment management, execution of the Order and / or shipment), of any claims relating to the guarantee of the article and / or recommendations or instructions to the Customer related to the article.
In time of any change to these Terms and Conditions, S.M.I. will promptly publish the new Terms and Conditions changed on the site.
The amended Terms and Conditions will become an integral part of new contracts, as of the first order placed by the Customer, following their publication on the Site. In the case of already submitted orders before notification, will apply the previous version of the Terms and Conditions .
The company S.M.I. has, for all stages of access to the site, the ordering process, delivery, customer service or after-sales services, only an obligation of means.
Subsequent amendments He can’t be held responsible for any inconvenience or damage arising from the use of the Internet, such as service problems, computer viruses or external invasions.
